Prenuptial agreements: The practical side of wedding plans

Dresses, flowers and venues, along with other details, often preoccupy Louisiana residents who are planning their weddings. Creating the perfect day to memorialize their decision to wed is exciting, fun and sometimes frustrating. However, a wedding only lasts a day, and many couples are thinking much farther into the future by including prenuptial agreements in their wedding plans.

Some may say that this type of practicality takes away from the splendor and joy of the day, but dealing with financial issues prior to marriage could actually strengthen the relationship. Money remains a top reason for divorce, and avoiding the topic prior to the wedding will not make it go away. For couples who have already been through a divorce, a prenuptial agreement may be the insurance they need in order to feel more comfortable about going down the aisle again.

For couples who marry later in life or remarry, significant assets, a business and/or children from a prior relationship may need protecting. Identifying separate assets ahead of time could provide each party with the peace of mind that should something go wrong, each of them will walk away with the assets with which they came into the marriage. Even if a prenup is not considered romantic, it could provide a much needed sigh of relief that some of the couple’s financial affairs are in order before the big day.

Louisiana couples who decide to enter into prenuptial agreements need to make sure that they comply with current law. Certain requirements must be met in order to help keep the agreement valid should it be needed. Each party may benefit from taking the opportunity to discuss the matter with an attorney prior to signing for a number of reasons, including making sure that his or her best interests are served and rights are protected by the agreement.
